Independent orthopaedic expert evidence from Mr Peyman Bakhshayesh. Medicolegal work has a separate fee schedule from clinical consultations. Please contact the practice to discuss the scope, records, funding and agreed terms of an instruction.

Agree the instruction before work begins.

Contact the practice to confirm scope, availability, records, deadlines, funding and the written engagement. Confirm the total quotation, including any applicable tax and expenses.

These terms concern professional medicolegal instructions. The cancellation and late-payment provisions below do not set the policy for ordinary clinical consultations.

Fees

The hourly fee is £250 for all professional time spent on a case.

Preparation of a report typically requires a minimum of eight hours. Correspondence is charged with a minimum of 15 minutes.

Supplementary reports are charged at £500.

Court attendance is charged at £2,000 per day, based on an eight-hour day at £250 per hour. This fee is payable even if the expert is not called to give oral evidence.

Expenses

All reasonable expenses, including postage and telephone calls, are charged at cost. Necessary mileage is charged at £0.50 per mile. Copies of receipts can be provided on request.

Payment

In cases other than legally aided cases, payment is required within 30 days of the invoice date, regardless of whether the instructing party's client has paid them.

For legally aided cases, prompt claims to the relevant funding body are expected, together with notification of any anticipated delay. Funding arrangements should be confirmed for the particular instruction.

Under the agreed medicolegal engagement terms, overdue accounts may incur interest, at the practice's discretion, at 2% per month or part of a month until full settlement.

Cancellation and non-attendance

Court appearances cancelled within two working days are subject to the full daily court fee. Cancellations between two and five working days are subject to 50% of the daily fee.

Missed medicolegal examination appointments, or cancellations with less than 72 hours' notice, incur a £250 fee.

Independent expert duty

Mr Bakhshayesh acts as an independent expert witness. His overriding duty is to the Court, rather than to the instructing party or client.

Records and report preparation

All relevant GP records, hospital records and radiographs should be available before consultation. If relevant documents are unavailable, they may need to be incorporated into a supplementary report charged at the stated rate.

Electronic records must be clear, legible and in chronological order. Additional time required to reorder, print, paginate or prepare records is charged at the hourly rate.

Large bundles of notes and imaging will normally be returned to the instructing party for safekeeping after review.
